The problem of copyright in the situation of unrecognized authorship is a subject of interdisciplinary analysis at the intersection of art criticism, jurisprudence, and cultural theory. The issue of illegal and anonymous street art is characterized by a certain marginality in terms of copyright protection. Researchers face a certain dilemma: street art is a recognized trend in contemporary art, but its objects are practically not protected by copyright. The article is devoted to aspects of intellectual property protection in the situation of anonymity of the author. The works of the street artist Banksy, who does not currently claim authorship of his works, are the subject of commercial use and reproduction, in which rights of the author are actually ignored. The article considers questions of attribution and legal standards applied to anonymous works in the context of the UK and the United States law, as well as possible precedents in case the artist claims authorship over his work.
