Вопрос о допустимости изъятия имущества, закрепленного за бюджетным учреждением, рассматривается автором статьи в контексте публичной природы отношений, возникающих в связи с управлением государственным имуществом. Принятие уполномоченным органом решения об изъятии имущества, закрепленного за бюджетным учреждением, ориентировано на целевой характер закрепляемого имущества. Учитывая сложившуюся систему «расщепления» полномочий по управлению имуществом, контролю за использованием имущества, принятию решений об изъятии имущества интерес представляет судебная практика, складывающаяся в связи с оценкой необходимости согласования решения об изъятии имущества, закрепленного за бюджетным учреждением. Кроме того, в статье обращается внимание на судебную оценку обстоятельств использования (невозможности использования) имущества, закрепленного за бюджетным учреждением при разрешении споров по данной категории дел.

Annotation:
The question of the admissibility of seizure of property assigned to a state-financed organization is considered by the author of the article in the context of the public nature of relations arising in connection with the management of state property. The adoption by the authorized body of a decision on the withdrawal of property assigned to a state-financed organization is focused on the targeted nature of the property to be fixed. Taking into account the existing system of “splitting” of the powers for property management, control over the use of property, making decisions on withdrawal of property, it is of interest to practice in the courts, which is formed in connection with the assessment of the need to coordinate the decision on the withdrawal of property assigned to a budget institution. In addition, the article draws attention to the judicial assessment of the circumstances of use (inability to use) of the property assigned to the state-financed organization in resolving disputes in this category of cases.
