The article covers the problems connected with the possibility and necessity of establishing of the truth in the court within criminal cases. The definitions of the substantive truth and the formal legal truth are analyzed. The approaches to the content of these definitions within various historical periods in the works of the scientists in criminal procedure fields are disclosed. The discussion regarding the restoring the additional investigation institute and authorize the court with the accusatory powers is reviewed. The reasons of the legislative initiative concerning for reappearance of the additional investigation institute are analyzed.
