Russian legislation establishes that, in addition to subjective rights, interests are also subject to legal protection in court. According to paragraph 1 of Article 3 of the Civil Procedure Code, an interested party has the right, in the manner established by civil procedure legislation, to apply to the court for the protection of violated or disputed rights, freedoms, or legitimate interests. Paragraph 1 of Article 4 of the Arbitrazh Procedure Code states that an interested party has the right to apply to an arbitrazh court for the protection of their violated or disputed rights and legitimate interests. This article examines various perspectives on the concept of „legitimate interest“ and attempts to express a personal position on this concept.
