On the basis of the analysis of the interesting defi nition of the Supreme Court of the Russian Federation the author is pursuing an answer to the question: what remedy is applicable to return from private ownership to public ownership a withdrawn or limited in commerce property.(In particular she is exploring the rei vindicatio action, the action for the declaration of the right of ownership and the action for the declaration of the right of ownership absence.
