The problem of system affiliation of the international procedural law is investigated in this work. The eidos (εἶδος) of the international procedural law is substantiated as a necessary component of the normative legal system. It is offered to understand a set of legal rules performing “rights-protecting” functions as the procedural norms. It is proved that the principle of the right to protection is a special fundamental principle of the procedural law which forms modern systems of dispute resolving means both between power-bearing subjects of the international law and non-power-bearing actors of the international relations. The fragmentariness of modern international procedural law is noted.
