The discussed question of the moment of the emergence of the norm about the criminal responsibility for the kidnapping is considered in the article. The separate law acts are analyzed for the identification such a norm in them. The question about the influence of the philosophic views to the generation of the criminal legislation and implemented in Russian legislation law acts of foreign legislation, consisted the norm about criminal responsibility for the kidnapping, are investigating. Various norms, similar to the norm about the criminal responsibility for the kidnapping, but protect another object as property or family legal relations are analyzed. The author view to the moment of the emergence of the norm about the criminal responsibility for the kidnapping as a norm to protect personal physical freedom is cited.
