In the text of the article, the norms of the criminal law with numerous
amendments and additions are subjected to retrospective analysis on three tracks (property,
entrepreneurial activity, taxation). Using the theoretical framework of the economic analysis of law,
the author comes to the conclusion that the effectiveness of the modern model of criminal legal
impact on business is ensured by shifting from the protective to the fiscal function of the criminal
law.
