The article is devoted to the postulation of the main ideas of arbitration. In the context of Russian realities, arbitration is viewed as a point of confrontation between the state and civil society. Modern regulation of arbitration in Russian law is based on a conservative approach, which generates dissatisfaction of the civil society.
